These Terms of Service (the “Terms”) govern your use of the website, protocols, services, and tools (collectively, the “Services”) offered by Chrome International LLC, operating 4Real.Finance (“4Real”, “we”, “us”, “FR” or “our”). By accessing or using the Services, you agree to comply with these Terms. If you do not agree, you must discontinue the use of the Services immediately.

4Real Finance is treasury-backed protocol designed to capture the most efficient DeFi yields in the Solana ecosystem

The protocol is based on a treasury of hard assets that generate real yield for stakers, ranging from liquid staking to stable-coins. 4Real Finance goal is to maximize long-term token holder value, balancing between distributing revenue back to it’s holders and solidifying real yield strategies.

Adaptive Fee System

Protocol revenue is generated from a set of dynamic fees, following the market conditions, funding its treasury, incentivising long-term staking without relying on a bonding mechanism.

1. Acceptance of Terms

By accessing or using 4Real’s Services, you confirm that you are at least 18 years old, have the legal capacity to enter into these Terms, and agree to be bound by these Terms, our Privacy Policy, and all other applicable law, guidelines, policies, or terms that we may provide from time to time.

2. Account Registration and Access

To participate in 4Real’s Services, including staking and yield programs, you must connect through an authorized wallet. You are solely responsible for securing your account and wallet credentials. You agree to immediately notify us of any unauthorized use or breach of your account. We reserve the right to suspend offering Services to any account at our sole discretion if we suspect any unlawful or harmful activity.

3. Use of Services

The Services are provided to you on a non-exclusive basis, and you are granted a limited license to use them for personal purposes, subject to these Terms. You agree not to use the Services for any unlawful purposes or in violation of any applicable laws, regulations, or rules.

4. Staking and Real Yield Program

By participating in our staking and yield-generation programs, you acknowledge the inherent risks associated with blockchain technologies, including volatility, the potential for total loss, and operational challenges. You are responsible for conducting your own research and verifying the risks before staking tokens or using the Services. 4Real does not provide any guarantee of returns, and all staking is done at your own risk.

5. Fees and Billing

You agree to pay any applicable fees as outlined in the publicly available docs provided on our website. These fees may include transaction fees, withdrawal fees, and other service-related charges. 4Real reserves the right to adjust its fees, without prior notice. Fees are non-refundable.

6. AML and AFC Compliance

4Real adheres to strict Anti-Money Laundering (AML) and Anti-Financial Crime (AFC) regulations. You acknowledge that you will not use our Services to engage in activities related to money laundering, terrorism financing, fraud, or any other illicit activities. We may request documentation to verify your identity and transactions, and we reserve the right to freeze or close accounts that do not comply with these regulations.

7. Risk Disclosure

You understand and accept the risks associated with the use of decentralized finance (DeFi) products, including, but not limited to, market volatility, the potential for losing all of your tokens, and smart contract vulnerabilities. 4Real makes no representations or warranties about the security, functionality, or availability of its protocols or services.

8. Governance

Holders of 4Real tokens may participate in governance decisions related to the platform, including voting on proposals to determine the future development and operation of the platform. Governance proposals do not create any fiduciary obligations on behalf of 4Real, and all governance decisions are subject to technical feasibility and regulatory compliance.

9. Intellectual Property

All intellectual property, including the website design, code, trademarks, logos, and other proprietary information, are owned by 4Real or its affiliates. You agree not to copy, distribute, modify, or otherwise infringe upon these rights without explicit permission.

10. Third-Party Services

Our Services may integrate with third-party platforms, such as wallet providers and liquidity pools. 4Real is not responsible for the security, functionality, or performance of these third-party services and assumes no liability for their actions.

11. Limitation of Liability

In no event shall 4Real, its affiliates, directors, or employees be liable for any indirect, incidental, special, or consequential damages, including but not limited to lost profits, arising from the use of or inability to use the Services. The total liability of 4Real shall not exceed the fees you have paid for the use of the Services over the past six months, or $100, whichever is greater.

12. Indemnification

You agree to defend, indemnify, and hold 4Real harmless from and against any claims, losses, damages, liabilities, and expenses (including legal fees) arising out of your use of the Services or breach of these Terms.

13. Termination

We may terminate or suspend your access to the Services at any time, with or without notice, if we believe you are in breach of these Terms, involved in unlawful activities, or otherwise harming the ecosystem.

14. Dispute Resolution

All disputes arising out of or in connection with these Terms shall be resolved through binding arbitration in the Marshall Islands, under ICC rules. By agreeing to arbitration, you waive your right to a jury trial or participation in a class action lawsuit.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the Marshall Islands, without regard to its conflict of law provisions.

16. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on our website, and your continued use of the Services after changes have been made constitutes your acceptance of the new Terms.
